الشروط والأحكام للمستخدمين User Terms & Conditions

باستخدامك لتطبيق Picks، فإنك توافق على جميع الشروط والأحكام المذكورة أدناه. إذا كنت لا توافق على أي من هذه الشروط، يرجى عدم استخدام التطبيق. By using the Picks app, you agree to all the terms and conditions listed below. If you do not agree to any of these terms, please do not use the app.

التعريفات Definitions

"المنصة" تعني تطبيق Picks وجميع خدماته المرتبطة. "المستخدم" يعني أي شخص يستخدم التطبيق للبحث عن الأنشطة التجارية والتفاعل معها. "المحتوى" يعني أي معلومات أو بيانات أو رسائل يتم تبادلها عبر المنصة. "Platform" means the Picks app and all its related services. "User" means any person who uses the app to search for and interact with businesses. "Content" means any information, data, or messages exchanged through the platform.

الأهلية والتسجيل Eligibility and Registration

يجب أن تكون بعمر 18 سنة أو أكثر لاستخدام المنصة. بالتسجيل في المنصة، تؤكد أنك: You must be 18 years or older to use the platform. By registering on the platform, you confirm that you:

تبلغ من العمر 18 سنة أو أكثر وتتمتع بالأهلية القانونية الكاملة Are 18 years or older and have full legal capacity
ستقدم معلومات دقيقة وصحيحة Will provide accurate and truthful information
ستحافظ على سرية بيانات حسابك Will maintain the confidentiality of your account data
تتحمل المسؤولية الكاملة عن جميع الأنشطة التي تتم عبر حسابك Take full responsibility for all activities conducted through your account

الاستخدام المقبول Acceptable Use

تلتزم بعدم استخدام المنصة لأي من الأغراض التالية: You agree not to use the platform for any of the following purposes:

انتهاك أي قوانين محلية أو دولية Violating any local or international laws
إرسال محتوى مسيء أو مضلل أو غير قانوني Sending abusive, misleading, or illegal content
التحايل على أي تدابير أمنية أو تقنية Circumventing any security or technical measures
إزعاج المستخدمين الآخرين أو الأنشطة التجارية Harassing other users or businesses
جمع بيانات المستخدمين الآخرين بطرق غير مصرح بها Collecting other users' data through unauthorized means
إنشاء حسابات وهمية أو متعددة Creating fake or multiple accounts

إخلاء المسؤولية Disclaimer

إخلاء مسؤولية شامل Comprehensive Disclaimer

تُقدم المنصة "كما هي" دون أي ضمانات من أي نوع. نحن لا نضمن دقة أو اكتمال أو موثوقية المحتوى المنشور من قبل الأنشطة التجارية. لا نتحمل أي مسؤولية عن أي أضرار مباشرة أو غير مباشرة قد تنتج عن استخدامك للمنصة. The platform is provided "as is" without any warranties of any kind. We do not guarantee the accuracy, completeness, or reliability of content published by businesses. We assume no responsibility for any direct or indirect damages that may result from your use of the platform.

إنهاء الحساب Account Termination

نحتفظ بالحق في تعليق أو إنهاء حسابك فوراً ودون إشعار مسبق في حالة انتهاك هذه الشروط. يحق لك أيضاً حذف حسابك في أي وقت من خلال إعدادات التطبيق. We reserve the right to suspend or terminate your account immediately and without prior notice in case of violation of these terms. You may also delete your account at any time through the app settings.

تسوية النزاعات Dispute Resolution

أي نزاع ينشأ عن استخدام المنصة سيتم حله وفقاً لقوانين المملكة العربية السعودية. تتنازل عن حقك في رفع دعوى جماعية ضدنا. Any dispute arising from the use of the platform will be resolved according to the laws of the Kingdom of Saudi Arabia. You waive your right to file a class action lawsuit against us.

تعديل الشروط Terms Modification

نحتفظ بالحق في تعديل هذه الشروط في أي وقت دون إشعار مسبق. استمرارك في استخدام المنصة بعد التعديل يعني موافقتك على الشروط الجديدة. We reserve the right to modify these terms at any time without prior notice. Your continued use of the platform after modification means your agreement to the new terms.

الشروط والأحكام للأنشطة التجارية Business Terms & Conditions

اتفاقية الخدمة Service Agreement

هذه الاتفاقية تحكم علاقتك التجارية مع منصة Picks. بإنشاء حساب تجاري، فإنك توافق على جميع البنود المذكورة أدناه. This agreement governs your business relationship with the Picks platform. By creating a business account, you agree to all terms mentioned below.

التسجيل التجاري Business Registration

للتسجيل كنشاط تجاري، يجب أن: To register as a business, you must:

تمثل نشاطاً تجارياً شرعياً ومرخصاً Represent a legitimate and licensed business activity
تقدم معلومات دقيقة وحديثة عن نشاطك Provide accurate and up-to-date information about your business
تكون مخولاً قانونياً لتمثيل النشاط التجاري Be legally authorized to represent the business
تبلغ من العمر 18 سنة أو أكثر Be 18 years or older

الاشتراكات المدفوعة Paid Subscriptions

نموذج الاشتراك: Subscription Model:

جميع الاشتراكات المدفوعة هي اشتراكات سنوية All paid subscriptions are annual subscriptions
السعر المعروض قد يكون شهرياً للوضوح، لكن الدفع سنوي فقط Displayed price may be monthly for clarity, but payment is annual only
لا توجد استردادات للاشتراكات المدفوعة تحت أي ظرف No refunds for paid subscriptions under any circumstances
يتم تجديد الاشتراك تلقائياً ما لم يتم إلغاؤه قبل انتهاء المدة Subscription renews automatically unless cancelled before expiration
في حالة عدم التجديد، ستفقد المزايا المدفوعة فوراً If not renewed, paid benefits will be lost immediately

سياسة عدم الاسترداد No Refund Policy

جميع المدفوعات نهائية وغير قابلة للاسترداد. لا نقدم استردادات جزئية أو كاملة لأي سبب، بما في ذلك عدم الاستخدام أو إلغاء الحساب. All payments are final and non-refundable. We do not provide partial or full refunds for any reason, including non-use or account cancellation.

المحتوى والمنشورات Content and Posts

بنشر المحتوى على المنصة، فإنك: By posting content on the platform, you:

تؤكد أنك تملك الحقوق الكاملة للمحتوى Confirm that you own full rights to the content
تمنحنا ترخيصاً مجانياً وغير قابل للإلغاء لاستخدام المحتوى Grant us a free and irrevocable license to use the content
تتحمل المسؤولية الكاملة عن دقة وقانونية المحتوى Take full responsibility for the accuracy and legality of the content
توافق على عدم نشر محتوى مخل بالآداب أو مضلل Agree not to post immoral or misleading content

البيانات والتحليلات Data and Analytics

نجمع ونحلل بيانات شاملة حول نشاطك التجاري بما في ذلك المشاهدات والتفاعلات والرسائل. هذه البيانات تُستخدم لتحسين الخدمة وقد نشاركها مع المستخدمين أو أطراف ثالثة لأغراض تحليلية. We collect and analyze comprehensive data about your business including views, interactions, and messages. This data is used to improve the service and may be shared with users or third parties for analytical purposes.

إخلاء المسؤولية التجارية Business Disclaimer

حدود المسؤولية Liability Limits

لا نضمن زيادة المبيعات أو العملاء. لا نتحمل مسؤولية أي خسائر تجارية أو فرص ضائعة. المنصة أداة تسويقية فقط ولا نضمن النتائج. We do not guarantee increased sales or customers. We are not responsible for any business losses or missed opportunities. The platform is a marketing tool only and we do not guarantee results.

إنهاء الخدمة Service Termination

يحق لنا تعليق أو إنهاء حسابك فوراً دون إشعار أو استرداد في حالة انتهاك الشروط أو الاشتباه في نشاط احتيالي أو مخالف للقانون. We have the right to suspend or terminate your account immediately without notice or refund in case of terms violation or suspected fraudulent or illegal activity.

قد نشارك معلوماتك الأساسية وبيانات التفاعل مع الأنشطة التجارية التي تتفاعل معها لتحسين خدماتها وتخصيص عروضها لك. We may share your basic information and interaction data with businesses you interact with to improve their services and customize their offers for you.

خدمات الموقع Location Services

نستخدم موقعك الجغرافي لعرض الأنشطة التجارية القريبة منك وتحسين التوصيات. يمكنك إيقاف خدمات الموقع من إعدادات جهازك، لكن هذا قد يؤثر على جودة الخدمة. We use your geographic location to display nearby businesses and improve recommendations. You can disable location services from your device settings, but this may affect service quality.

الاحتفاظ بالبيانات Data Retention

نحتفظ ببياناتك إلى أجل غير مسمى ما لم تطلب حذفها صراحة. حتى بعد حذف الحساب، قد نحتفظ ببعض البيانات لأغراض قانونية أو تشغيلية. We retain your data indefinitely unless you explicitly request deletion. Even after account deletion, we may retain some data for legal or operational purposes.

النشر والظهور Publication and Visibility

جميع المعلومات التي تقدمها قد تظهر للمستخدمين في المنصة. نحتفظ بالحق في استخدام اسم نشاطك وشعارك في مواد التسويق والترويج لخدماتنا. All information you provide may appear to users on the platform. We reserve the right to use your business name and logo in marketing and promotional materials for our services.

الاحتفاظ والأرشفة Retention and Archiving

نحتفظ بجميع بياناتك التجارية بشكل دائم، حتى بعد إنهاء الحساب، لأغراض تشغيلية وقانونية وتحليلية. هذا يشمل سجل الرسائل والتفاعلات والمحتوى المنشور. We retain all your business data permanently, even after account termination, for operational, legal, and analytical purposes. This includes message logs, interactions, and published content.

المعلومات المالية Financial Information

نجمع ونعالج معلومات الدفع الخاصة بك بما في ذلك تفاصيل البطاقة الائتمانية وسجل المعاملات. هذه المعلومات محمية وفقاً لمعايير الأمان المصرفية. We collect and process your payment information including credit card details and transaction history. This information is protected according to banking security standards.

التحليلات والإحصائيات Analytics and Statistics

نوفر لك تحليلات مفصلة عن أداء نشاطك. في المقابل، نستخدم هذه البيانات لتحسين خدماتنا وقد نشاركها مع أطراف ثالثة في شكل مجمع ومجهول الهوية.
